In cases where social services accidentally violates HIPAA & sends your medical records to a 3rd party, can?
you sue and if so, what for?
If the violation was accidental and the recipient was a licensed medical provider then there’s very little you can do. Unless the transfer of records results in significant personal damage to you (such as an employer or insurer who receives information about your medical condition that affects your chances of maintaining medical coverage or employment) your lawsuit will be viewed as opportunistic and most likely will be thrown out, or you’ll be given a small settlement.
