Motion to quash subpoena?
I served my daughters (age 16) social worker a subpoena to testify for a hearing of my daughters primary residency? She has filed a Motion to Quash and tells me that I need to retract the subpoena. She has been very helpful til now. She tells me HIPAA protects my daughters rights and confidentiality. I live in Maine. Please advise.
HIPAA does protect your daughter’s rights and confidentiality. It does not necessarily defeat a subpoena. Generally, parents are privy to their daughter’s medical and psychological records.
There are plenty of exceptions.
Without a more complete story, a meaningful answer is impossible. My first blush reaction to what I read is that the social worker is blowing smoke out of a bodily cavity where the sun does not shine. On the other hand, I do not know what you are leaving out of this narrative.
