Can I sue my doctor for loosing my medical records and scarring my eyes?
Hello I had fraxil laser surgery on my face 1 1/2 years ago. I was told it would be inavasive.
It scarred by lower eye lids, I have lumpy scars under my lower eyelid skin. It makes me look very
tired my eyes are dark, sunk in, crepy and lumpy. I wanted to go to a doctor a Stanford to get advise on the scaring, I called the office to get my before pictures and they told me there computer system crashed and they didnt back it up and lost my before pictures, then a couple weeks later I asked for the procedure notes they said they lost those also. They had everything in my file except the 2 most important things the pics and procedure notes. so now i have no records to show a doctor so they know what my eyes looked like before or the procedure that was done. can I sue her in small claims? She has violated several Hipaa and Health and Safety violations. Please help

That sounds extremely suspicious and she is definitely in violation of a number of laws. It may be a form of surgical malpractice?
