Can I sue for a HIPAA violation? What actions do I need to take?
My husband has been getting calls from collection agencies for the past couple of years for a man with the same name and birthday. Just their socials and middle initials do not match. Well now to make matters worse I received an explanation of benefits from his medical insurance stating that they paid over $2,000 to a hospital that I have never even heard of. The bill had gone into collections and they skip traced it to my husband and called his insurance and got my husbands information. Isn’t this a violation of our privacy? Can I sue for this? What steps do I need to take to make sure this doesn’t happen again?
