Hipaa Violation? What?
My best friends mother recently was fired due to what they said was a “Hipaa Violation”. But listen to the story. Her mother worked in medical records, and as they were downstaffing one day, her employer told everyone to hurry up and get all their papers off their desk, so they could leave early. She totes a little small paper bag that she takes her notepad, paper, and supplies in. In a hurry, she just took all her papers off her desk slug them in her bag, and was going to clock out. Her employer saw one pink sheet in her bag (only containing a patients name, no other info!), and told her to throw it away immediately. My friends mother said “Oh my goodness, I didn’t realize I put that in there with my other papers” and shredded it. The next day she was fired stating she violated Hipaa. However, she never even left her office, or took any papers with her. Is this right?
First of all, if your friend’s mom works in at “at will” state, she can be terminated for any reason whatsoever, except discrimination.
Second, she had PHI (private health information) of a patient in her possession and was heading out the door with it. Unintentional or not, that is definitely a HIPAA violation which would warrant a warning at minimum. It can be grounds for termination and I think it sounds like her employer was looking for a reason to fire her.
