is it legal for my company to force me to fill out the HealthMedia Succeed booklet?

I’ve just recently started working for a company who, after starting up all of our health benefits, is forcing all of it’s workers to fill out a “Health Survey”. I have no problem with a Health Survey as long as it is optional, but when a company is forcing it’s employees to answer questions like “Are you currently being treated for depression or bipolar disorder by a psychiatrist, psychologist, or other health professional?” and “have you had a colonoscopy in the last 10 years?” (very abbreviated set of examples.. this is a 19 page booklet) I begin to wonder if this is even legal with HIPAA Privacy laws and what not. if anybody could shed some light on this subject I would greatly appreciate it.

I understand your concern and would be concerned myself, but let me try to shed some light on the subject. It sounds from your post that they are “starting up” their benefits for the first time in that company or maybe even changing carriers. In a case like this, it’s the insurance carrier that is requiring that survey.

When our company first started offering health benefits, we all had to fill out a survey. As the HR Specialist, I was concerned about keeping those surveys containing protected information on our employees. But we had to have them filled out and sent to the insurance carrier for our plan to be approved. It’s been so long, but I think we ended up sending copies for some reason and I had to keep the originals here in the files. That was fine, but it meant I had to be even more protective of who was allowed in those files! (I do that anyway, but it made me nervous at first.)

So, to ease your mind, it’s not something the employer likely wants to have, it’s something that the carrier is requiring of them so that they can decide on whether to keep the rates as quoted to your company for benefits. Just fill out the information as requested. Ask your employer about it if you still feel uncomfortable. Ask where these surveys will be kept – will they be kept in your separate medical files or your personnel files. (They are required to keep information like that in your medical file which is to be kept separate from your employee file.)

One other note: if I remember correctly, when we were getting our benefits for the first time, EVERYONE had to fill out the survey, even if they weren’t intending to get benefits. Again, this was several years ago, so I could be wrong, but I’m pretty sure we all did. Theoretically, someone could refuse them now, but have a qualifying event later on, so they wanted to know all of the current employees’ medical history.

So, bottom line – just ask them about it! It is legal as long as they don’t share that information or use it against you, which is not what the intent of that information is for anyway. Just hang in there.
