HIPAA violation punishment?
I work for a long-term care facility. Yesterday I got into trouble with administration and security for having patient documents in my car. The idea was that I wanted to take some work home with me, because it’s far easier to work at home, away from the hospital. However, the hospital doesn’t see it that way–they seem to view it as a breach. Could I possibly be charged (fined, jailed) for a HIPAA violation? I know it was a dumb thing to do and it looks like I’ll be fired for it today, but I’m not sure how the law works and if the hospital might file a complaint against me? Thanks.
No, they’re talking about filing charges against me. I knew it wasn’t good, but I didn’t understand the gravity of all of this. I expect to get fired, but I’m terrified of criminal charges.
You didn’t violate any HIPAA laws. You didn’t breach patient confidentiality by having the records sitting in your car. It wasn’t as if you were sitting in a bar talking about how Mary Smith has dementia. If the hospital has a policy that you can’t take work or patient charts home etc, they need to show you in writing where that rule is stated. I would fight getting fired and hire an attorney or seek help from an group you have within the facility that helps with employee rights.
