What options do I have when my HIPAA rights have been violated?

As a 22 year old private pay patient I went to my PCP and had some tests run, a STD test to be exact. A few weeks later I got a call from my parents saying they received a bill in their name with me listed as the patient detailing the tests that were run. I would think that especially due to the nature of the tests I had done there is some kind of action I can take against the doctor. I don’t want anyone else to have to go through this. I feel like there was no doctor patient confidentiality and don’t want to go back to this doctor in fear of this happening again. I would just like to know what my rights are at this point. Thank you so much for any input you may have.

That depends – had you seen this physician before? Had you changed your contact and insurance information on your chart?

HIPAA is a medical professionals duty, but if the patient is not providing them with accurate information then it becomes very difficult.

I would call them and inform them of their error and verify your information with them at that time. You may also report them for the violation, and they may be fine if the error was considered a blatant violation and not an error made because of old information.
