Did my doctor violate HIPAA? Can I sue?
The background info: I suffer from depression and anxiety. I just started taking citalopram and soon willl start undergoing therapy.
Now: B/c of my depression/anxiety, I missed a good chunk of days from school. It was 5 days for my last absence. So my dad called the doctor and asked to fax a note for my absense, and my doctor said that it was fine and that she’d take care of it.
SO I get called into the VP’s office and he reads me the note she faxed.
My doctor wrote that she is not excusing me from school, AND RELEASE THAT I WAS SUFFERING FROM DEPRESSION AND ANXIETY and the she was “working with me.”
Did she violate Hippa?
Just to add, My Dad did not sign anything to have my circumstances released.
AND, for suing, if it’s for emotional distress?

You’re a minor, you can’t sue until you’re 18.
If someone were willing to sue on your behalf, they would lose. Your father asked the doctor to fax a note, which counts as a release. He gets to make that request, not you. He is the adult.
Your doctor only complied with the request your dad made.
Sounds like you are angry the doctor didn’t say what you wanted him to say. Evidently, he believes you were well enough to attend school.
I would just attend school. It’s better for you.
