Under HIPAA, are doctors allowed to? PLEASE HELP?
A friend of mine has terminal cancer, meaning shes dying. She doesn’t want her husband to know that the doctor said that theres no more help. Her husband know that theres no treatment left, hewas informed of this but he does not know tha the doctor withdrew tretment.
He INSISTS her husband needs to know, and that she has no right to say no or to decline and that he has every right to tell him and he will with force. SHE IS TILL COMPLETELY LUCID AND ALIVE. her husband signed the agree ment with her about obtaining patient records, but to my knowlede as long as she’s concious, she can make her own decision.

He is not being unfair, but trying to be fair to the Husband. Doctors will be given some rope with trying to convince a patient to tell their spouse life altering information. That being said he is not allowed to tell the husband what the situation is with out her permission. If/when she looses is unable to make the choices for herself and the husband takes over that process, the doctor will be allowed to share full disclosure of the case. It will be clear that she has been hiding it at this point, however it could cause hard feelings.
It sounds like the doctor is just trying to give his advice having been in this situation many times before, he may just be trying to prevent of from having any regrets at the end of her life.
