Breach Of Confidentiality?
My employer has recently given out my medical information to a third party. I realize that this is a breach of HIPAA violation. However, rarely any civil cases are rewarded for the predominant HIPAA lawsuits. Can I sue them for breach of confidentiality? And where could I find some good lawyers who would want to take this case?
I researched online where a guy had won a lawsuit for breach of confidentiality and he was rewarded $14.4 million. I live in a small town and really need some good lawyers to reply to this because we don’t have any here.
You didn’t provide a lot of detail. For one, is your employer also your health care provider? HIPAA only applies to health care providers (doctors, clinics, insurance, pharmacy, etc.), not to anyone that has that information.
If you want to pursue a lawsuit, contact a lawyer. You can sit down and go over in much more detail that you can on a public forum your case, and he/she can decide if it’s possible based on the laws where you live.
And since you live in a small town without any lawyers, you just may have to take a trip up to the big city to visit one.
