By law, the doctor’s patient files are the property of the doctor and are subject to HIPAA rules of privacy. The patient may request and is entitled to obtain a complete copy with payment of a reasonable copying fee. If the doctor is being sued, he may share the file with his defense lawyer. Anyone else would need the patient’s signed permission to view or receive the patient’s file. The doctor does NOT have to release the patient’s files to anyone else, even against a subpoena from the court judge. The doctor, to protect against a HIPAA violation could release the files to the judge’s custody alone, allowing the judge to decide whether the court judge will then release the patient’s file to anyone else.
