Can HIPAA help me in getting new insurance?
Hi I have precondition and last year I had COBRA insurance after I stopped working. Now former employer’s group coverage was cancelled(maybe they went out of business or decided not to give coverage to all employees) so I received two letters one that my COBRA coverage is terminated as well as my HIPAA rights letter. So now can I call insurance companies and have insurance excluding my pre condition? Last year I had called insurance companies many times and asked to have individual medical insurance because COBRA rates were too high but because of preconditiona all denied me coverage. So will getting HIPAA right help me in anyway?

HIPAA won’t help you, this past year, COBRA rates were reduced by 65% per gov’t subsidy. If you go without insurance for I think, 63 days, between policy coverages obtain a new policy, you can be made to wait 90 days before coverage of a pre existing condition. Congressman Sestak supports this bill and is trying to get it extended. Perhaps call the previous insurance company, ask if they have an individual policy or can recommend one for you. Hopefully, you have a job w benefits and they employ more than 20-50 people for group health coverage and fed laws apply for disability, FMLA, STD and LTD disability?
