Asking employees if they had any insurance claims-hipaa?
I would like to find out if any of our employees had any health insurance claims in October because the insurance underwriter has been on bereavement leave and it is a month later and they still haven’t instated our insurance. If the employees haven’t had any claims, I would like to change our effective date so they don’t have to pay for insurance they didn’t use. We still haven’t received cards, but the insurance company told us the employees could go back and make the claim manually later. Is it legal under hipaa laws for me to ask they if they had claims, but not what for?
I don’t know the answer to your question, but if I were your company’s senior management, I’d be raising hell with that insurance company or switching to another. Its unacceptable that all insurance processing stops due to the absence of one person.
