Is my behavioral therapy provider misinterpreting HIPAA by using it to restrict visitation?
I have a 3 year old with Autism who attends a behavioral therapy clinic 39 hours per week.
Previous clinics have had an open door policy to parents – visit kid anytime.
This clinic has a more restrictive policy:
- If I want to visit my child during lunch, they need HIPAA permission from the parents of all other children he is having lunch with.
- If I want to visit, they have to clear the halls of patient care discussions and/or restrict my child to the closed-circuit observation room.
I think they may be misinterpreting HIPAA and taking it too far. If I have a kid at a childrens hospital or any care facility, I can walk around, even have a drink by the nurses station without issue.
Are they interpreting HIPAA correctly? If not, how do I effectively communicate/prove that to them?

It is a “strict interpretation”, but is not a “misinterpretation”.
They are just trying to avoid being sued (and, with our litigious society, this is not unreasonable).
Ask the clinic if they will start a policy where parents wanting to visit during lunch can start a “lunch club” and provide blanket permission to the other parents in the “lunch club”.
