Patient Consent Hipaa

patient consent hipaa

Is a nursing student protected by HIPAA from an instructor talking about his/her PHI.?

A fellow student gave me a IM vaccine everything was behind closed doors the instructor was present. The instructor then talked about amongst other faculty and students without written or oral consent. Even though I’m her student at that point and time I was a Patient. Am I protected with HIPAA on this and should I do something?

The instructor has the right to talk about it as long as it falls under 1 of 3 things. Training, Payment or Operations. However, if she has not received your consent, she is still required to protect your private health information (those things that would identify the patient as “you”). At that would be unless he was discussing a treatment concern with his supervisor, as that would be allowed.
