Do patients have to sign HIPAA forms annually?
Someone told me that patients must resign HIPAA forms on an annual basis. I thought as long as the HIPAA authorization is kept on record, they do not expire.
PATIENTS do not have to resign HIPAA forms annually. There is no ‘renewal’ signing required. If however, you go to a NEW medical provider, then YES, you will be asked to sign another HIPAA form but, keep in mind, it is not mandatory that you sign the form. You cannot be denied treatment for refusing to sign. However, if information is disclosed to a non-covered entity, it may no longer be protected under HIPAA
On the other hand, EMPLOYEES of medical providers, facilities, companies, etc must sign a form every year that basically says, in so many words, they are knowledgable with the HIPAA rules and regulations and will follow them. Not doing this on an annual basis is a HIPAA violation in and of itself.
