What penalties are associated with HIPAA violations both at the personal and institutional levels? ?

You have two penalties here:

1. Facilties in violation of HIPAA polices may be fined
2. Employees who committed HIPAA violations can be fired but not fined.

It hardly matters though in the former instance above. HIPAA and its enforcement have proved to be nothing more than a ‘paper tiger.’ There have been thousands of well-documented valid complaints made to the Department of Health and Human Services that enforces HIPAA but to date, not one facilty has been fined one cent. This being the case and as there is no precedent, it’s really impossible to say what the fines may be but I imagine they would be in line with the severity of the violation(s).

But it does work to an extent. Employees have been fired for being in violation of HIPAA. In the news and among them were several employess of the hospital where Britany Spears was hospitalized. These people, who were not directly involved in Britany’s care, werre snooping in her medical records on the hospital’s computer system. This is a HIPAA no-no.
