Can the pharmacist give out prescription information to other people?
My husband received an email from his estranged mother today asking him if he is okay because she went to the pharmacy to pick up her prescription and the pharmacist told her that her son had one to pick up as well. Apparently, the pharmacist also told his mother what it was for. Is this as illegal as I think it is? Doesn’t this violate HIPAA? (She has continued to badger my husband all day asking him how he is so sick and using this to tell him that marrying me was a horrible idea.)
HIPPA, in regards to a pharmacist, refers to RECORDS. It would be illegal for the pharmacist to provide a record of his purchases, but in the interchange with your MIL, that is just bad form. However, if he could prove harm, he could sue them and win. Being badgered by his mother is not harmful, since he could put a stop to it if he wanted to.
Clearly, your husband needs to move his business elsewhere and should tell the pharmacist exactly why he is doing so. At the same time, he should chew out his mother for pressing for information that was clearly none of her business.
