What is required if an employee doesn’t follow the privacy policy of HIPAA?
When must the employees be trained, by whom, and in what manner?
Anyone who will have access to protected health information that works for a “covered entity” should have HIPAA training at orientation before they actually are given such access to any patient record. The training is generally done by staff with expertise in medical records, or a designated “Privacy Officer”. Each “covered entity” can develop their own policies concerning the training. There is no mandated federal training, but there are some for profit consulting firms that can provide the training if no one at the particular covered entity has been trained. Also, you can check with local hospitals, as some have periodic trainings that you may be able to sit in on. Remember that lack of training is not an excuse to violate the law, so somehow, everyone with access to protected health information must know about HIPAA.
