Does HIPAA affect the patient’s access to his/her medical records?

HIPAA does not affect a patient’s access to his own medical records; it affects everyone else’s access to a patient’s medical records – it is a pretty wide-reaching act, too. It doesn’t apply just to your paper records, but to discussions with your physician, your insurance company, anything that is relative to your medical treatment. For example, your wife wants to call her husband’s doctor’s office to check on an invoice and to see if it has been paid. Unless her husband has signed a HIPAA authorization on file with his doc’s office, she is not able to do even this simple thing. Getting your records is easy: you must sign a form or request them in writing. You can give others access to your medical records with a HIPAA authorization (your attorney, your spouse, etc.).
