Bottom line? It amounts to a typical Fed CF (perdon a Francais). It creates a lot of extra work for health care agencies. It acts to slow effective transfer of info to clearly appropriate providers. Best of all? It does all this, & only generates revenue for the industries that popped up to operationalize it (digital doc services, equipment manufacturers, etc.). Revenues generated, & deterrence achieved through heavy fines for violations? Nope. They refuse to prosecute, even when given complete documentation of a clear violation. Ask me how I know…
I read an article written three years after HIPAA was enacted. Of over thirty thousand claims, exactly two were prosecuted. Both involved credit card numbers stolen from patient charts. One was an FBI agent. The other was probably his Mother. An example of violations not prosecuted: A software company selling a digital office suite. Rather than create ficticious patient charts. They just included a hundred real charts, w/full identifiers. There were many such claims that escaped enforcement. Why? Because the crooks in govt which were forced to enact some type of legislation, are afraid to anger their bribing lobbyist friends on the Hill. This isn’t personal opinion. This is fact, based on over twelve years in nursing. Look around the Net. You’ll find dirt, too.
