Defendant falsified an expired HIPAA document?
I am a pro se plaintiff in burglary/negligence/emotional distress suit and defendant falsified an expired HIPAA document which was in my previous files and tried to get all my therapy notes and documents. I go before the judge for a pre trial conference Monday but it is the same judge I am taking on appeal for not allowing me discovery and allowing difendant’s inaccurate and misleading statements to the court. Any help would be appreciated. I did win the right to appeal. The court is in New York
So what’s the problem, other than the fact you are pro se? (They say that a man who represents himself has a fool for a lawyer)
Are you worried that the judge is going to be petty because you appealed one of his decisions? Appeals are part and parcel of our justice system and a judge that showed that kind of favoritism in court will not remain a judge for long.
