HIPAA rules and hospital security video. ?
As a nursing student I was verbally attacked by another student in the lobby of a hospital. Because the attack was public and in the lobby, the administration of our university is trying to kick both of us out of school. I never responded to her attack and merely walked out of the hospital.
As I do not feel like I participated in this unprofessional behavior, I want the security tape in case I get kicked out and want to go to court for wrongful dismissal. When I sent a letter to Risk Management of the hospital asking for the tapes, they said the hospital lawyer is concerned that giving me the tapes would violate the patients’ HIPAA rights. However, the tapes I requested were in the lobby of the hospital. Are patients protected in the lobby? Or is it just patient care areas?
Sounds like a bogus argument to me, or at best, an overprotective interpretation of HIPAA. First of all, not everyone in the lobby area of a hospital is a patient and therefore, not assured of these rights merely by their presence there. Secondly, unless there is sound on the video that is also so sensitive so as to pick up confidential converstations of hospital staff with patients, mere presence in the hospital is also, not protected information under HIPAA.
