I would like to know if giving out my daughters surgery information is a HIPAA violation?
The hospital gave the information…time…date…etc. to my daughters grandmother. We do not have a good relationship with her as she has serious mental issues. We did not okay the desk to share any information with this woman. she was at another appointment and stopped at the desk and they gave her all the information she needed to show up. We did not want her to have this information, nor did anyone ask if it was okay to share this information. In fact, on my daughters charts at the clinic (the clinic and hospital are more or less the same entity) it states that the grandmother is not allowed to bring my daughter in for any type of treatment without my permission, which i would never give.
I am very upset with this.
Whether or not HIPAA was violated depends on the nature of the information released. Confirming a patient is in hospital or has an appointment is not covered by HIPAA, however disclosing what the procedure is might be,
The distribution of appointment information may be against hospital rules, the prior poster is correct you should contact their privacy/compliance officer.
