Hipaa Violation???????
I was in the hospital and signed that the hospital was to discuss with my time there with no one.
After the fact I found that my doctor was speaking to my husband about my treatment, telling him things I was saying and revealing to him that I’d been treated at the Mental Health portion of the hospital years before.
An administrator is looking into this, but since Friday night I was told about my mental health treatments (which he didn’t even know about, they were so long ago.)
Is there a spousal exclusion under Hipaa?
No. If you specify who can and cannot have access to your health information and the doctor violates that by giving information without your permission, then he’s violated HIPAA. On the other hand, if you gave permission for the doctor to speak to your husband and you didn’t specify that you did not want him to know about your mental health history, you can’t do much.
