Can you get medical reports of your diagnosis when paid by someone else?
Child Protective Services (CPS) in Texas paid for my wife’s mental evaluation. Can she request the doctor to give her the medical report even though she never paid for it? Because CPS just told her that she cannot get that report…
Any info of HIPAA or whatever would help ![]()
Who can she get it from? Can she get it directly from the doctor if she asks?

Under Hipaa law the only time a person can be denied access to their own record is if releasing the information would cause harm. Like if the doctor thought reading the medical record would cause her to commit suicide, it could be refused. What type of facility did the evaluation? Was it a private practice? If so, just get a hipaa release and submit it to them. If it was some sort of State psychiatric facility, there might be other considerations than hipaa. My suggestion would be to get a Hipaa release form and submit it to the facility which performed the exam. If you feel your hipaa rights are violated you should contact your regional Civil Rights office.
