I have proof my hipaa rights were violated. What can I do?
I went to the U of M hospital in January for some medical stuff and about 5 months later someone my husband knows got a text from his ex wife. It was exactly what I was talking to the doctors about. The ex husband saved the text. This was extremely private and personal stuff. She is a nurse there. Not even in the same department where I went. Help! I am sooo embarassed,and angry. Someone needs to pay!
Hipaa violations do not allow for “victims” receiving monatary rewards.
You can file a complaint about the hospital and if proven, the nurse will be reprimanded and most likely go through retraining.
You can’t sue on a HIPAA complaint though and expect to win money. At the very most, the govt might fine the hospital – you won’t get any money though. Embarrassment is not a reimbursable “expense” – only physical damage would be allowed as a malpractice lawsuit.
