HIPAA or Patient Privacy Question?
I have a question concerning patient privacy laws. Let’s just say that someone that I know has warrants out for his arrest. He comes to the hospital emergency room to get treated for something.
The ER Staff also knows that he has warrants out. The Hospital Security says that they can’t do anything with him, because he’s not causing a problem. And they won’t call the police because they say it’s HIPAA violation if they do. Is this true? I would think that having warrants out would trump any privacy laws. I live in Virginia if that helps.

Nope the security department is wrong. There is a specific exception to the privacy regulations for public safety and law enforcement (they are no laws, but regulations that implement the general concept of patient privacy). In fact, your hospital security could be charged for aiding the criminal you refer to.
