Is it legal for my director to tell her boss my confidential health information?
I work in human services. I disclosed to my boss this week that I was struggling with my thyroid (hypothyroid) and that was why I was sluggish. I told her I have an appointment on 11/6 to get checked out. I just found out this morning that she told our executive director, her boss, that I have that condition. Is that legal? She did not have my permission to disclose that. I know all about HIPAA but don’t know how it affects workplace. Thanks in advance
Not in HR, in human services – completely different field. I did not enact FMLA, my boss asked me if everything was okay. I told her the situation with my thyroid and that I was getting it straightened out.
Once you disclose this information, it becomes legal for your boss to inform her boss about it. She does not need your permission any longer.
